GENERAL CONDITIONS FOR THE PRODUCTS
These General Conditions of Use and Contract have the objective of regulating commercial transactions between the Owner and the Users.
The purchase of any of the products offered implies acceptance, without reservation of any kind, of each and every one of these general conditions of use.

OWNER'S RESPONSIBILITY
The products presented on the Site comply with Italian law.
Without prejudice to the case of willful misconduct or gross negligence, the Data Controller will not be liable for damages that may derive from interference, omissions, interruptions, computer viruses,
failures or disconnections in the operational functioning of this electronic system or in the devices or computer equipment of users, motivated by causes external to the Owner, which prevent or delay the provision of services in other electronic systems, nor the impossibility of providing service or allowing the access for reasons not attributable to the Owner due to the user, to third parties, or due to force majeure.

USER OBLIGATIONS
In general, the User undertakes to comply with these general conditions of use and to always operate in compliance with the law, morality and the requirements of good faith, acting with due diligence and refraining from using the website in any form that may prevent, damage or deteriorate the normal functioning of the same, the assets or rights of the Owner, its suppliers, and the rest of the users or third parties in general.

The User expressly undertakes to allow the delivery of the order by providing a "delivery address" to which the requested product can be delivered at the usual time for delivery of the goods.
The User also expressly acknowledges and accepts that in the event of a breach of this obligation, the Owner will have no responsibility for the delay or impossibility of delivering what has been requested by the User, reserving the right to cancel the purchase made.

PRODUCTS
All the Products and the prices indicated constitute an offer to the public with the limitations and methods contained on the Site and explained both in the previews and in the pages of the relative products.
Products belonging to the categories "Fruit and vegetables", "Dairy products", "Meats", "Bread and Fresh Pasta" will be delivered only in the Municipality of Campobasso and neighboring municipalities.
The Products belonging to the other categories will be delivered throughout the national territory (See Shipping Costs)

Variable weight products
Variable weight Products (e.g. fruit, vegetables, meat, fish, delicatessen products and cheeses) are offered on the Site in minimum guaranteed sizes and weights.
In the event that the Products purchased include one or more of these variable weight products, the Company will only apply the price calculated at the time of the order, without any consideration of increases o
price decreases, which may have occurred subsequently or previously concluded.

Products per pack
In the event that the Products purchased through the Services include one or more of these products per package, the Company will only apply the price calculated at the time of the order, without any consideration of price increases or decreases, even for promotions, which may have occurred subsequently or previously completed.
The illustrative photographs of the Products have a purely representative function and have the sole purpose of presenting the Products.

Consequently, the Company declines all responsibility and does not provide any guarantee with reference to the correspondence of the graphics of the Products published on the Website/APP and that of the Products delivered. All prices include VAT. The cost of delivery and service management is not included in the price of the Products

MINIMUM GUARANTEED QUANTITIES AND NATURAL DECREASE IN FRESH FRUIT AND VEGETABLE PRODUCTS
Fresh fruit and vegetables, except for the exceptions defined by the law, present in their product sheet the minimum guaranteed weight declared by the producer which defines the minimum quantity threshold to be given to the customer. The customer therefore receives a quantity equal to or greater than the declared quantity.
However, a tolerance due to natural decline is allowed on the weight of fresh fruit and vegetables, according to the species of the product, namely:
- for fruit in general, no more than 2%;
- for vegetables and legumes in general, no more than 5%.

PRODUCT PURCHASE
The Owner reserves the right to unilaterally change the price of the products and services offered through its web page at any time.
In any case, the Owner guarantees the customer that the price indicated at the time of formalization of the order cannot be subject to subsequent changes.
To proceed with an order, it is necessary to connect to the Site, select the desired product and then fill in the electronic form, following the instructions indicated therein.

SENDING THE PRODUCT
Once the purchase is complete, the User will automatically access a confirmation page and receive an email containing all the specifications of the product purchased with the relative order number.
The products will be sent to the shipping address provided by the User in the delivery data form. Shipping costs will be specified and legible.
The User acknowledges and accepts that by finalizing the purchase he gives his express consent for the Owner to provide his data to the company responsible for delivering the purchased product.
Generally the products are shipped within 5 working days from the completion of the order. In any case, the Owner undertakes to deliver the goods to the User without delay and at the latest within thirty days from the date
conclusion of the contract as required by Article 61 of the Consumer Code.

SHIPPING FEES
Shipping costs are charged to the User and are highlighted in the formulation of the purchase order. They vary according to the service requested by the User:
For Users who require delivery of fresh and non-fresh products in the Municipality of Campobasso and nearby, the cost of shipping is €00.00 including VAT.
For Users who require home delivery on the national territory, the rates take into consideration the following variables: weight of the order, volume of the order, destination, type of product to be shipped.
The rate will be automatically calculated when the order is formulated.
For Users who request collection at the Delivery Point, no shipping costs will be charged
For Users who require deliveries on foreign territory, from countries belonging to the European Union, please contact us. We will evaluate the feasibility and related costs by communicating them as soon as possible
The costs of storage, which arise from the non-delivery of the order, will be charged to the Customer, in cases where the personal data are incorrect, misunderstanding, missing fundamental parts that prevent normal delivery.

PAYMENT AND PROOF OF PURCHASE
The form of payment is by credit card, bank transfer or PayPal. In the event that the TPV communicates the refusal of the card, the purchase order will be automatically canceled, informing the customer online
of the aforementioned cancellation. Likewise, in the event of non-receipt of the bank transfer 5 working days after the registration of the order, the purchase order will be automatically canceled, informing the customer online of the aforementioned cancellation. For payments made with foreign cards, the Bank that issued them must comply with the Security Protocol for Secure Electronic Commerce (CES).
Payments with cards that do not meet this requirement are not accepted. The communication that the User will receive by email once the purchase is confirmed is valid as proof of the purchase made and for the purposes of the manufacturer's guarantee.
Despite this, an invoice may be requested, during and no later than, the purchase procedure indicating the data that will be required for the issue of the same. The User acknowledges and expressly accepts that
once the purchase procedure has been completed, it will not be possible to request the issuance of the invoice.

WITHDRAWAL POLICY, REFUND AND PRODUCT AVAILABILITY
Pursuant to art. 59, paragraph 1, lett. d) and e) of Legislative Decree 6 September 2005, n. 206 (Consumer Code), the right of withdrawal is excluded in relation to:
- Goods purchased by a non-consumer User and/or who requires an invoice;
- Goods that are likely to deteriorate or expire rapidly; And
- Sealed goods which do not lend themselves to being returned for hygienic or health protection reasons and which have been opened after delivery.

With reference to the cases of exclusion of the right of withdrawal listed above, the User, in particular, is informed and accepts that among the Products that "risk to deteriorate or expire rapidly" include all
food products, since the characteristics and qualities of these types of Products are subject to alteration also as a result of inappropriate storage. Therefore, for hygienic reasons and for the protection of Users, the right of withdrawal is applicable only for Products purchased on the Website www.agricolaceresetto.com which can be returned intact in their respective seal, and put back on the market without endangering the health of consumers.
The User may exercise the right of withdrawal, pursuant to art. 52 et seq. of Legislative Decree 206/2005, in relation to specific Products, other than those falling within the categories listed above, provided that these, after delivery, have not been opened or their seals altered.
In cases where the exercise of the right of withdrawal is permitted, the User has the right to withdraw from the purchase contract for any reason, without the need to provide explanations and without any penalty.
To exercise the right of withdrawal, the User must send tostudioceresetto.contabilita@gmail.com, within 14 days from the date of delivery of the Products, a communication with the subject "Exercise of the right of withdrawal", to which he must expressly declare his intention to withdraw and providing the following additional information:
- purchase order number and date;
- delivery date of the purchase order;
- the name and address of the Client;
- the indication of an e-mail and telephone number of the Customer;
- name and code of the item or of the items for which you intend to exercise the right of withdrawal.

The right of withdrawal applies to the Product purchased in its entirety; therefore, if the Product is made up of several components or parts, the right of withdrawal cannot be exercised only on part of the Product purchased.
Upon receipt of the communication of exercise of the right of withdrawal, the Owner will open a file for the management of the return and communicate to the User the instructions on how to return the Products, which will take place by courier indicated by www.agricolaceresetto.com
In case of exercise of the right of withdrawal, the Owner will reimburse the User for the full amount of the returned Products, within 14 days from the date on which the communication of withdrawal was received, without prejudice to the right of_cc781905-5cde-3194-bb3b- 136bad5cf58d_
Dalcontadinoacasatua.it to suspend the payment of the refund until the actual receipt of the Products. The refund will be made using the same payment method used by the User.
If the product is not available due to force majeure, the Owner will notify the User directly, proposing alternative solutions to the requested product, and the due and immediate reversal of the purchase value.

ONLINE CONSUMER DISPUTE RESOLUTION
The consumer residing in Europe must be aware of the fact that the European Commission has set up an online platform that provides an alternative dispute resolution tool.
This tool can be used by the European consumer to resolve any dispute relating to and/or deriving from contracts for the sale of goods and services stipulated online.
Consequently, if the User is a European citizen, he can use this platform for the resolution of any dispute arising from the online contract stipulated with the Owner.
